By using the Platform, you confirm that you are at least 18 years old or have appropriate consent from a parent or guardian, possess the legal authority to enter into these Terms, and agree to comply with all applicable laws and regulations. If you are using the Platform on behalf of an educational institution or organisation, you warrant that you have the authority to bind that entity to these Terms.

Our AI Lesson Planning Assistance utilises sophisticated business rule engines to analyse student data and curriculum requirements, automatically generating personalised teaching plans through integration with leading AI model APIs. This system aims to reduce preparation, whilst improving educational outcomes through targeted differentiation and adaptive content delivery.

Our AI Assessment and Grading Support utilises machine learning algorithms, enhanced by intelligent prompt-switching, to analyse student submissions against defined criteria such as learning outcomes and rubrics. When using our AI features, please review AI-generated content before use, maintain academic integrity and authenticity in all work, respect intellectual property rights in AI interactions, utilise AI to enhance rather than replace critical thinking and learning, and report any inappropriate AI responses through our support channels. You acknowledge that AI suggestions are not guaranteed to be error-free and that human oversight remains essential for all educational decisions.

Our AI systems utilise third-party APIs enhanced by our proprietary business rule engines to provide contextually appropriate responses. Whilst we continuously improve these systems, you understand that AI outputs may require verification and should not be relied upon without proper review and validation.

7. Content and Intellectual Property

However, you grant us a limited, non-exclusive licence to use your content for Platform operation, feature development, and service improvement, subject to our Privacy Policy and data protection obligations.

We own all Platform software, AI algorithms, business rule engines, and proprietary content. You receive a limited licence to use Platform features for educational purposes. AI-generated content, including lesson plans, assessment suggestions, and tutoring responses, is created through our systems but may be used by you for educational purposes, subject to appropriate attribution and compliance with academic integrity standards.

Educational institutions remain responsible for ensuring their use of our Platform complies with their regulatory requirements, including those imposed by Ofsted, awarding bodies, and other educational oversight organisations.

10. AI Services and Technical Infrastructure

10.1 AI Limitations and Human Oversight

AI suggestions and recommendations are not guaranteed to be error-free or appropriate in all circumstances. Human oversight and professional judgment remain essential for all educational decisions. AI performance may vary depending on the quality of input, context, and the complexity of the academic requirements. We do not guarantee specific educational outcomes or student success rates, as these depend on numerous factors beyond our control, including our AI systems.

You acknowledge that our AI features are tools to enhance education rather than replace human expertise and judgment. Final responsibility for educational content, assessment decisions, and student outcomes remains with qualified academic professionals.

10.3 Technical Infrastructure

Our Platform is currently hosted on Render and/or Amazon Web Services (AWS), ensuring scalability, security, and performance. We maintain appropriate service level agreements with our hosting providers and implement comprehensive backup and disaster recovery procedures. Third-party integrations are managed through secure APIs and authorised connections that support data protection and security standards.

11. Service Availability and Support

We aim to provide reliable access to our Platform with minimal downtime, excluding scheduled maintenance periods that will be announced in advance. Our support services are available through multiple channels, including email, documentation, and user forums. Response times and support levels may vary based on your subscription tier and the nature of your inquiry.

Emergency maintenance may occasionally be required with minimal notice to address security issues or critical system problems. We will communicate such maintenance through appropriate channels and work to minimise disruption to your educational activities.

12. Payment Terms and Pricing

Subscription fees are based on your selected service tier and user count, with payment due in advance for subscription periods. All fees are non-refundable unless otherwise stated in writing or required by applicable consumer protection laws. We may modify pricing with reasonable advance notice; however, existing subscribers will maintain their current pricing until their renewal.

Payment processing is handled through secure third-party providers, including PayPal and Stripe, subject to their respective terms and conditions. You are responsible for ensuring your payment information remains current and for any fees charged by your bank or payment provider.

13. Limitation of Liability

To the maximum extent permitted by law, we provide the Platform "as is" without warranties of any kind, whether express or implied. We are not liable for indirect, consequential, or special damages arising from your use of the Platform. Our total liability to you for any claims related to the Platform is limited to the fees paid by you in the twelve months preceding the claim.

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of the Platform, violation of these Terms, infringement of third-party rights, or your content or activities on the Platform. This includes reasonable legal fees and costs associated with defending against such claims.

15. Termination

You may terminate your account at any time by contacting our support team or through your account settings. We may terminate accounts for violating these Terms, non-payment of fees, engaging in illegal or harmful activities, or posing a threat to Platform security. Upon termination, your access to the Platform will cease; however, some data may be retained for legal compliance purposes, as outlined in our Privacy Policy.
